Agreement
These Terms of Use (“Terms”) govern your use of burchx.com and of services from BurchX, LLC (“BurchX”, “we”, “us”), a Florida limited liability company, including the BurchX Console and the BurchX Alerts text message program. By using them, you agree to these Terms. If you do not agree, do not use them.
If you have a separate written agreement with BurchX, that agreement governs the services it covers, and these Terms apply wherever it is silent.
Using our website and services
You may use our website and services only for lawful purposes and in line with these Terms. You agree not to:
- try to gain unauthorized access to our systems or to anyone else’s account;
- interfere with or disrupt the website or services, including by sending excessive or automated requests;
- use the website or services to break any law or to infringe anyone’s rights;
- give us information that is false, or a phone number or email address that is not yours to give.
Intellectual property
The website and its content, and the BurchX name and logo, belong to BurchX, LLC or its licensors. You may view the website and link to it. You may not copy, modify or reuse its content, or use the BurchX name or logo, without our written permission, except as the law allows.
Feedback
If you send us ideas or feedback, we may use them without any obligation to you.
SMS Terms (BurchX Alerts)
These SMS Terms apply to BurchX Alerts, a text message program from BurchX, LLC that sends alerts about service incidents and deployments.
- Who receives messages. BurchX Alerts are sent only to people who add their own mobile number to the alert settings in the BurchX Console and agree to receive alert texts about service incidents and deployments. By doing so, you confirm that you are the subscriber or authorized user of that number.
- Message frequency. Message frequency varies with the number of incidents and deployments.
- Costs. Message and data rates may apply. Check your mobile plan for details.
- Opting out. Reply STOP to any message to cancel. We will send one message to confirm that you have been unsubscribed, and after that you will receive no further messages. You can also remove your number from your alert settings in the BurchX Console. To receive alerts again, reply START.
- Help. Reply HELP to any message for help, or contact us at hello@burchx.com.
- Delivery. Carriers are not liable for delayed or undelivered messages. Messages can be delayed or go undelivered for reasons outside our control, so do not rely on BurchX Alerts as your only way of learning about an incident.
- Changing your number. If you change or give up your mobile number, remove it from your alert settings first so that alerts do not reach someone else.
- Privacy. We handle your mobile number as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Disclaimers
The website and services are provided “as is” and “as available”. To the fullest extent permitted by law, BurchX disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the website or services will be uninterrupted, error-free or always available.
Limitation of liability
To the fullest extent permitted by law, BurchX and its members, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or revenue, arising from or relating to the website or services. Our total liability for any claim arising from or relating to the website or services will not exceed one hundred U.S. dollars (US$100).
Indemnity
You agree to indemnify and hold harmless BurchX from any claims, losses and expenses, including reasonable attorneys’ fees, arising from your misuse of the website or services or your breach of these Terms.
Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the website or services will be brought in the state or federal courts located in Duval County, Florida, and you consent to their jurisdiction.
Changes to these terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page. If you keep using the website or services after a change, you accept the updated Terms.
